Acceptable Use Policy

The web site http://www.hostingbuzz.com.au is owned and operated by registered business Hosting Buzz (ABN: 87 978 468 973 ). Your access and use of the provided services shown on this site is conditional upon your acceptance and compliance with the terms, conditions, policies, notices and disclaimers contained in this document and elsewhere on the site.

If you do not wish to be bound by these legal notices, you may not access or use the Hosting Buzz site or order and use any of the Hosting Buzz products or services.

At any time and without prior notice, Hosting Buzz shall have the right, in its sole discretion, to modify, add or remove the terms, conditions, policies, notices and disclaimers contained in this document and elsewhere on the site, and all such changes shall be effective immediately. Users should review the legal notices periodically as subsequent use shall constitute acceptance of any such changes.

The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.

Our Acceptable Use Policy (AUP) is actively and strictly enforced. We reserve the right to determine what constitutes acceptable use. Violation will result in immediate deactivation of services and removal from our network without refund, usually as soon as they are discovered, although we will always inform you when and why any action has been taken.

If you are unsure about content you intend to place on our network, please check with us before you do. Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.

Illegal Activity
Engaging in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software.

Undesirable Content
Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. Audio and video downloads may only be hosted if you are the creator and copyright owner of the work. Copyrighted Media can not be publicly distributed.

Inappropriate E-Mail Activity
Commercial E-mail - Defined as sending unsolicited commercial e-mails. This is prohibited. You are not permitted to use your Hosting Buzz account or e-mail alias/account of your Virtual Server to send unsolicited commercial e-mail. Using an e-mail address hosted anywhere on Hosting Buzz servers to collect responses from unsolicited commercial e-mail is prohibited. This also includes using third party e-mail accounts or servers including free ones to promote or spamvertise your Hosting Buzz based virtual web server account and redirectors for the same account. Please note we subscribe to Spam Cop services to monitor all inappropriate email activity.

Mail Bombing - Defined as sending large volumes of unsolicited e-mail to individuals from your Hosting Buzz based Virtual Server account. This is strictly prohibited.

Harassment - Defined as sending threatening or harassing e-mail after being requested to stop, is prohibited. Extremely threatening or harassing e-mail never is allowed.

Forging of Headers - Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

Usage Limits - The combined total of all email sent via your web hosting account must not exceed a maximum of 20 pieces of email per minute and 1000 pieces of email per 24 hour period. Sites that deal in email that exceed these limits need utilise a third part email service or use dedicated servers because they have no place in our shared server platform.

Inappropriate Newsgroup Activity
Newsgroup Spamming - Defined as excessive cross-posting, or posting the same article to several newsgroups. This is prohibited. Generally accepted standards allow no more than 15 newsgroups, or cross-postings, for a single article or substantially similar articles. Such articles may be canceled. You are not allowed to use your Hosting Buzz based mail facilities to SPAM the newsgroups.

Off topic or inappropriate postings - There is no restriction on content, except as defined by each newsgroup. Continued posting of off-topic articles is prohibited. Please note that commercial advertisements are off-topic in the vast majority of newsgroups. We take a very dim view of SPAM. It is one of the most annoying things encountered on the Internet. If an Hosting Buzz customer found to be spamming we will take action immediately. If we find that you have violated our No-SPAM Policy, we will disable your account and report you and the incident to the proper local, state, and federal authorities if necessary.

Misuse Of Resources
Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation without prior warning. Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy, IRC bots and mailing list scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and as such is not allowed. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum.

Intellectual Property Violations
Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. Hosting Buzz is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also Hosting Buzz's policy to terminate the privileges of customers who commit repeat violations of copyright laws.

Obscene Speech or Materials
Using Hosting Buzz's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material. Hosting Buzz is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through Hosting Buzz's network.

Defamatory or Abusive Language
Using Hosting Buzz's network as a means to transmit or post defamatory, harassing, abusive, or threatening language.

Illegal or Unauthorized Access to Other Computers or Networks
Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.
